The Clery Act requires institutions follow certain procedures when resolving allegations of sexual misconduct via institutional disciplinary proceedings. These procedures must be followed whenever an institution will investigate or resolve an allegation of Dating Violence, Domestic Violence, Sexual Assault or Stalking, regardless of whether Title IX applies (and regardless of whether the 2020 or 2024 regulations apply). 

This webinar will review the key procedural requirements that must be followed, including but not limited to allowing parties to be accompanied to proceedings by an advisor of their choice, providing simultaneous, written notification of the results; and providing both parties with the same opportunities to have others present during institutional disciplinary proceedings. The be explored include procedural requirements (including simultaneous written notification), participation of advisor, and affording the parties the same opportunities to have others present during any institutional disciplinary proceeding. The webinar will further explore the Clery Act’s requirements to provide prompt, fair, and impartial proceedings as well as related issues with which student conduct practitioners should be familiar (e.g., the written statement of rights and options that must be provided to student and employee victims of sexual misconduct). By better understanding the Clery Act’s procedural and substantive requirements pertaining to sexual misconduct allegations, student conduct personnel will be better equipped to support institutional compliance efforts while simultaneously ensuring implementation of fair proceedings.
