Adjudicating Free Expression Disciplinary Cases at American Colleges: Considerations for Student Conduct Professionals

2024 offered many opportunities for American colleges and universities to consider its approaches and responses to free expression events on campus; most notably, perhaps, is weighing the line between constitutionally protected expression and conduct prohibited under the code of conduct. While there have been a wealth of Webinars and training that have focused on education around the First Amendment as well as campus response to protest events, this Webinar addresses a gap in the literature which is the direct adjudication of code violation reports stemming from campus free expression events. Particular focus will be placed on policy, information dissemination, investigation/adjudication related to both individuals and organizations, and outcomes/sanctions, including a model education conversation script, as well as differences based on institutional type/control/size. While this Webinar will discuss working with your institution’s Title IX office and Title IX personnel may benefit from content, the focus is on the resolution of code conduct infractions.

Learning Outcomes:

As a result of participating in the webinar, participants will:

  • Be exposed to effective practices around the adjudication of prohibited expression disciplinary cases involving both individuals and organizations on public and private colleges, including sample policies, potential outcomes and sanctions.
  • Participants will gain the ability to critically analyze institutional policies and effectively distinguish between constitutionally protected expression and conduct violations in alignment with their campus code of conduct.
  • Participants will learn to craft appropriate outcomes and sanctions for free expression-related violations and implement a model educational conversation script to engage students in understanding the impact of their actions.
  • Consider challenges faced by presenters at their home institutions involving political pressures, arrests, and referrals of students for alleged violations of campus policies.
  • Participants will have the opportunity to engage in a safe and supportive virtual environment with fellow student conduct professionals, fostering dialogue and addressing questions related to the adjudication of free expression disciplinary cases.

Presenter Bios:

Marc H. Shook, Ph.D., J.D.: currently services as AVP, Dean of Students, and Deputy Title IX Coordinator at the University of South Carolina where he also co-leads the university’s SEED Team (Safely Engaging in Expression Delegates) which provides support for free expression events on campus. Prior to USC, he was the Vice President for Student Engagement at LaGrange College and his professional positions have spanned the University of Texas at Austin, the University of Alabama, the University of Virginia, as well as Presbyterian College. Dr. Shook is a former member of the ASCA board of directors, ASCA representative on the CAS board, Gehring faculty, Gehring assessment chair, and Student Conduct 101 instructor for legal issues. He is a frequent conference presenter and consultant in the areas of legal issues, including First Amendment protections, and crisis management.

Katie McGee, M.S, B.A., serves as Associate Vice President and Dean of Students for the University of Texas at Austin. She oversees the 11 units within the department, including student organizations, volunteer/service learning, student support, student conduct, and student governmental organizations. She leads a team of eighty five in providing robust programming, trainings, supports, interventions, and organizational advising for the more than 900 student organizations on campus. Prior to taking the role as Dean of Students, Katie has worked as an education executive, with over 20 years of experience navigating complex organizational environments and building effective systems of student support including work as Assistant Vice President for Academic Innovation for the University of Louisiana System, program coordinator for Louisiana Department of Education, and Assistant Dean of Students at Louisiana State University. She is a former member of the ASCA board of directors where she also chaired the fraternity and sorority community of practice and was a member of the finance committee.

Dr. Roland N. Bullard, Jr. is an accomplished higher education leader with over 25 years of experience, having served as Vice President and Dean of Students at multiple institutions, primarily within private universities and HBCUs. His expertise lies in navigating complex student conduct cases, developing strategic frameworks, and fostering environments that balance free expression with institutional values. Currently serving as Vice President for Student Affairs at St. Thomas University in Miami, he holds a Ph.D. in Higher Education Policy from Indiana University and has completed executive training at NASPA, Harvard, and other leading organizations.
